What Are Driver Ability Reviews?

Indiana Driver Ability Department conducts reviews to evaluate an individual’s physical and mental fitness to operate a motor vehicle. The goal of these reviews is to ensure that individuals are able to safely operate a vehicle without putting themselves or others at risk. However, they can unfairly target older individuals and those with certain medical conditions or disabilities. These reviews can result in a driver's license revocation, invalidation, or restrictions.

Who Requests Driver Ability Reviews?

Driver ability reviews can be requested by a variety of individuals, including:

  • Doctors or healthcare professionals who have concerns about a patient's ability to drive due to a medical condition
  • Law enforcement officers who observe someone exhibiting behaviors that may indicate they cannot safely operate a vehicle
  • Family members who have concerns about a loved one's driving abilities

Requests may not be made anonymously.

Does the Department Automatically Conduct a Review After Receiving a Request?

No, the department must determine that a review is warranted based on the evidence it receives. This may include medical records, statements from family members or law enforcement officers, and other relevant information. If the department elects to move forward with a review, they will provide the driver with notice in 10 to 14 business days.

It is important to note that if you have received notice of a Driver Ability review, you are required to comply with its terms within 60 days. Failing to do so may result in the immediate suspension of your license.

Defending Your License & Options for Challenging a Review Decision

Facing a Driver Ability review can be overwhelming and intimidating, but you do not have to go through it alone. With the help of an experienced Indianapolis driver’s license medical disqualification attorney like myself, you can protect your right to drive. I can work with you to gather evidence and present a strong defense to the department, advocating for the preservation and/or reinstatement of your driving privileges.

If your driver’s license is ultimately revoked or restricted, there are options for appealing the decision. According to the Indiana Bureau of Motor Vehicles (BMV), you may request a formal administrative hearing to challenge the review findings and present evidence in your favor. You must make this petition within 18 days of receiving notice of the department's decision.

Does all this sound overwhelming? Let me handle the details. I can guide you through making a petition, build a strong case in your favor, and work to achieve a favorable outcome.

Do not let a Driver Ability review threaten your independence. Take action now by contacting the Christopher W. Grider Attorney at Law to schedule a free consultation with a trusted Indianapolis driver’s license medical disqualification attorney.
